- 2023: IRMO ALULDDIN v. ALFARTOUS, Arizona Court of Appeals, Division I – “Ali” signed an agreement that would give a $25,000 dowry to “Qamar”, $15,000 “present,” and $10,000 upon demand. Upon filing for the divorce Ali claimed none was owed: he had already paid $15,000 and was responsible for the $10,000 only if he initiated the divorce. The trial court ordered Ali to pay $25,000, plus attorney’s fees. The Appellate court affirmed: Religious premarital agreements are enforceable in divorce cases if the agreements meet the requirements applicable to premarital agreements, and other contracts between people in confidential relationships.
